By accessing or using MailWise ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

MailWise is an AI-powered email analytics and assistant platform that:

• Connects to your Gmail account via OAuth 2.0
• Analyzes and categorizes your emails
• Generates AI-powered email summaries and responses
• Identifies action items and calendar events
• Provides email management and productivity features

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use MailWise. By using the Service, you represent that you meet these requirements.

4. Account Registration

• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must not share your account credentials
• You must notify us immediately of any unauthorized access
• One account per person; no multiple accounts without authorization

5. Gmail API Authorization

By connecting your Gmail account, you authorize MailWise to:

• Read, compose, and send emails on your behalf
• Access email metadata (subject, sender, timestamp)
• Create and manage email drafts
• Access Gmail labels and categories

You can revoke this authorization at any time through your Google Account settings or MailWise dashboard.

6. Subscription Plans and Payments

6.1 Plan Types

• Free Plan: £0/month - Perfect for trying out MailWise (60 emails per month, AI email categorization, basic draft generation, email summaries, standard support)
• Starter Plan: £23/month - For professionals managing moderate email volume (500 emails per month, AI email categorization, advanced draft generation, email summaries, multiple tone options, priority support, Gmail integration)
• Professional Plan: £63/month - For teams and heavy email users (2000 emails per month, AI email categorization, advanced draft generation, email summaries, all tone options, priority support, Gmail integration, custom templates, analytics dashboard)
• Enterprise Plan: Custom pricing - For organizations with custom needs (unlimited emails, AI email categorization, advanced draft generation, email summaries, all tone options, 24/7 dedicated support, Gmail integration, custom templates, advanced analytics, API access, custom integrations)

6.2 Billing

• Subscriptions are billed monthly in advance
• Payments are processed securely through Stripe
• Prices are in GBP (British Pounds) and subject to change with 30 days' notice
• 7-day money-back guarantee on paid plans
• No refunds for partial months or unused features after the guarantee period
• Failed payments may result in service suspension

6.3 Cancellation

• You may cancel your subscription at any time
• Access continues until the end of the current billing period
• No automatic refunds upon cancellation
• You may reactivate your subscription at any time

7. Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal purpose
• Violate any laws or regulations
• Send spam or unsolicited commercial emails
• Attempt to gain unauthorized access to the Service
• Reverse engineer or decompile the Service
• Use automated systems (bots) without authorization
• Abuse or overload our infrastructure
• Resell or redistribute the Service without permission
• Impersonate others or provide false information

8. AI-Generated Content

• AI-generated email drafts and summaries are suggestions only
• You are responsible for reviewing and editing AI content before sending
• We do not guarantee accuracy or appropriateness of AI outputs
• Always verify sensitive information before relying on AI suggestions

9. Data Usage and Privacy

• Your use of the Service is governed by our Privacy Policy
• We comply with Gmail API Limited Use requirements
• We do not sell your personal data or email content
• You retain all rights to your email data

10. Intellectual Property

• MailWise owns all rights to the Service, including software, design, and branding
• You retain ownership of your email content and data
• You grant us a limited license to process your data to provide the Service
• You may not copy, modify, or distribute our proprietary materials

11. Service Availability

• We strive for 99.9% uptime but do not guarantee uninterrupted access
• Scheduled maintenance will be announced in advance when possible
• We are not liable for service interruptions or data loss
• We may modify or discontinue features with reasonable notice

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• MailWise is provided "AS IS" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the past 12 months
• We are not responsible for third-party services (Gmail, OpenAI, Stripe)
• You use the Service at your own risk

13. Indemnification

You agree to indemnify and hold harmless MailWise from any claims, damages, or expenses arising from:

• Your use of the Service
• Violation of these Terms
• Infringement of third-party rights
• Your email content or actions

14. Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or abusive behavior
• Fail to pay subscription fees
• Pose a security risk

Upon termination, your data will be deleted according to our Privacy Policy.

15. Modifications to Terms

• We may update these Terms at any time
• Significant changes will be notified via email or in-app
• Continued use after changes constitutes acceptance
• If you disagree with changes, you must stop using the Service

16. Dispute Resolution

16.1 Governing Law
